Direct answer
A brand, legal company, product, service and founder have different properties, ownership relationships, evidence and life cycles. The relationships among them should be recorded, but they should not be merged as though they were one entity.
In plain language
For a restaurant, the sign is the brand, the organisation holding the operating licence is the company, a dish on the menu is a product, home delivery is a service and the person who created the business is the founder. They are connected, but they are not the same thing.
Why this matters
When these identities are mixed, a founder's personal property may be assigned to the company, a product award to every service of the brand, or ownership to an operator who does not own the brand.
Do not confuse
- A brand and a registered trade mark are not the same concept.
- A company name need not be the same as its brand name.
- A product may be a tangible or licensable offering; a service may be an activity.
- Being a founder does not mean being the current owner or manager.
What should you do?
- Create a separate stable identity for each entity type.
- Record ownership, operation, production, delivery and founding as separate relationships.
- Record the date and evidence for every relationship.
- Use the correct type on web pages and in structured data.
- Do not transfer one entity's property automatically to a related entity.
How do you audit it?
- Was the brand presented as the legal company?
- Was a product's success generalised to the whole company?
- Was the founder treated as the current authorised person?
- Were ownership and operation separated?
- Does each entity have its own sources and validity dates?
Limit
Separate records are used to model relationships correctly, not to break them. Legal trade mark and company status must be assessed under the relevant registers and national law.
Remember in one sentence
Being connected is not being identical.
